IF YOU ARE A STALKER
OFFENCES
Depending on the specific case, the following offences may be considered (in France):
- Cyberbullying is a form of moral harassment defined by Article 222-33-2-2 of the Criminal Code.
It refers to "the act of harassing a person through repeated words or behaviour intended to
or resulting in a deterioration of their living conditions, leading to a deterioration of their health
physical or mental [...] when committed through the use of a communication service
online or via digital or electronic media. Cyberbullying is punishable by law by
two years' imprisonment and a fine of €30,000; if the victim is a minor, the penalties are
three years' imprisonment and a fine of €45,000.
It should be noted that the offence is constituted whether it is committed by a single person or a group of persons, and,
in the latter case, even though each of these persons did not act repeatedly.
Depending on the form and means of the actions of the perpetrator or perpetrators of cyberbullying: - Public insult or defamation (Article 32 of the Law of 29 July 1881): an offence punishable by a fine
of 12,000 euros. - Infringement of image rights (Articles 226-1, 226-2, 226-2-1 of the Criminal Code): the act of, by means of a process
Any person who deliberately infringes on the privacy of another person shall be punished by one year's
imprisonment and a fine of €45,000.
When the acts are committed by the victim's spouse or are of a sexual nature, the
penalties are increased to two years' imprisonment and a fine of €60,000. - The dissemination of pornographic content involving a minor (Article 227-23 of the Criminal Code): offence
punishable by 5 years' imprisonment and a fine of €75,000. - Identity theft (Article 226-4-1 of the Criminal Code): the act of usurping the identity of a third party or of making
use of one or more pieces of data of any kind that can identify them with the intention of causing them harm
tranquillity or that of others, or to damage their honour or reputation, shall be punished by one year
imprisonment and a fine of €15,000.
When the acts are committed by the victim's spouse, they are punishable by two years' imprisonment.
